GutCode – Terms of Service

1. Definitions

For the purposes of these Terms:

• "App" or "Service" refers to the GutCode mobile application.
• "We", "Us", or "Our" refers to GutCode, operated by Hanish Ali Köse, based in Germany.
• "You" or "User" refers to the individual using the App.
• "Content" refers to all data, text, images, and other materials within the App.
• "Health Data" refers to data accessed from Apple HealthKit with your permission.

2. Eligibility

You must be at least 16 years old to use GutCode (in accordance with EU/GDPR digital consent requirements). By using the App, you confirm that you meet this age requirement.

If you are under 18, you confirm that you have obtained consent from a parent or legal guardian to use this App.

3. Nature of the Service

3.1 What GutCode Does

• Tracks food intake, nutrition, and eating patterns
• Provides general wellness insights based on your logged data
• Integrates with Apple HealthKit to display activity data
• Uses AI to assist with food recognition (for convenience only)

3.2 What GutCode Does NOT Do

• Diagnose, treat, cure, or prevent any disease or medical condition
• Provide personalized medical or dietary advice
• Replace consultation with qualified healthcare professionals
• Guarantee accuracy of nutritional information or AI-generated insights

Always consult a qualified healthcare provider before making dietary changes, especially if you have existing health conditions, allergies, or take medications.

4. User Responsibilities

By using GutCode, you agree to:

• Provide accurate information when using the App
• Use the App only for personal, non-commercial purposes
• Not attempt to reverse-engineer, copy, or modify the App
• Not use automated tools, bots, or scrapers to access the Service
• Not use the App for any unlawful purpose
• Take responsibility for decisions made based on App information

5. Intellectual Property

All content, features, and functionality of the App (including but not limited to text, graphics, logos, icons, images, audio, software, and the compilation thereof) are the exclusive property of GutCode and are protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Content without our prior written consent.

6. Data & Privacy

Your privacy is important to us. Please review our Privacy Policy for detailed information about:

• What data we collect and why
• How we store and protect your data (locally on your device)
• Your rights under GDPR (access, rectification, erasure, portability)
• Third-party services used (e.g., AI food recognition)

6.1 HealthKit Data

If you grant permission, GutCode may access health data from Apple HealthKit. This data:

• Is stored only on your device
• Is never sold or shared with third parties
• Is never uploaded to external servers
• Can be revoked at any time in iOS Settings

7. AI & Data Accuracy Disclaimer

GutCode uses artificial intelligence for food recognition and nutritional analysis. You acknowledge and agree that:

• AI-generated results may be inaccurate, incomplete, or incorrect
• Nutritional data is based on public databases and may contain errors
• You should verify critical nutritional information independently
• We are not liable for decisions made based on AI-generated content

8. Subscription & Payments

GutCode may offer premium features through in-app purchases or subscriptions. If applicable:

• Payments are processed through Apple's App Store
• Subscriptions auto-renew unless cancelled 24 hours before the renewal date
• You can manage subscriptions in your Apple ID settings
• Refunds are subject to Apple's refund policy

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not warrant that the App will be uninterrupted, error-free, or secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App in the past 12 months, or €50, whichever is greater

10. Indemnification

You agree to indemnify, defend, and hold harmless GutCode and its operators from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

We may suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms or for any other reason at our sole discretion.

Upon termination:

• Your right to use the App ceases immediately
• Data stored locally on your device remains under your control
• You may delete all App data by uninstalling the App

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes:

• We will notify you through the App or via email
• The updated Terms will be effective upon posting
• Continued use after changes constitutes acceptance of the new Terms

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law principles.

13.1 For EU Consumers

If you are a consumer in the European Union, you benefit from mandatory provisions of consumer protection laws in your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law.

13.2 Informal Resolution

Before initiating formal proceedings, you agree to contact us first to attempt to resolve any dispute informally.

13.3 Jurisdiction

Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Germany. For consumers, mandatory local jurisdiction rules apply.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GutCode regarding your use of the App and supersede all prior agreements.

17. Language

These Terms are provided in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
